Will there be a by-election in Sutton Coldfield?

At the end of its report about the Plebgate police officers being recalled to parliament to apologise for their original evidence, the Observer has this paragraph:

[Andrew] Mitchell is expected to be nominated by David Cameron as Britain's next European commissioner, replacing Lady Ashton. An announcement is expected before the end of the year.
